Holiday Listings Terms and Conditions

These Terms & Conditions (“Terms”) govern your use of the holiday listing service (“Service”) provided by Cycle Touring Org (“we,” “us,” “our”), located at services.cycletouring.org. By subscribing to the Service and making payment, you (the company or individual identified at registration – “you,” “your,” “Advertiser”) agree to be bound by these Terms.

1. Scope of Service

1.1. The Service entitles you to submit and publish unlimited cycling holiday listings on the Site while your active subscription is in effect.
1.2. The Service is strictly limited to cycling-related holidays. We reserve the sole right to reject or remove any listings that we determine, at our discretion, to be inappropriate, fraudulent, offensive, unrelated to cycling, or in breach of these Terms, without prior notice or refund.

2. Listing Requirements

2.1. All listings must be current, available for booking, and offered for purchase at the time of submission.
2.2. Listings for past, cancelled, or expired holidays will be automatically removed from the Site.
2.3. You warrant that all content you submit is accurate, lawful, and does not infringe any third-party rights. You are responsible for updating content and correcting any errors.

3. Subscription, Payment & Renewal

3.1. Payments are accepted via credit/debit card only and processed securely through Stripe. We do not store card information.
3.2. Subscriptions automatically renew on the renewal date indicated in your account; renewal notices are emailed in advance.
3.3. You may cancel at any time via your account. Cancellation will take effect at the end of the current billing period; no pro-rata refunds are offered.
3.4. Refunds are available only if requested within 14 days of purchase and the Service has not been accessed (i.e., no login or submissions). To request a refund, contact us via the Site’s Contact form. After 14 days or after accessing the Service, no refund will be granted.

4. User Account & Communication

4.1. By subscribing, you consent to us collecting your name, email, username, website, and listing details.
4.2. We may contact you via your registered email address for system notifications, updates, billing alerts, changes in Terms, or other Service communications. Email addresses will be removed from distribution lists upon subscription expiration.

5. Limitation of Liability

5.1. We act solely as a platform provider and are not a party to any booking, contract, or transaction between you and your customers.
5.2. All holiday purchases occur directly between you and your customers; we do not facilitate payment processing.
5.3. We are not responsible for listing errors, availability issues, disputes, or any damages arising from your use of the Service.
5.4. Our total liability to you, under or in connection with these Terms, is limited to the total subscription fees paid in the preceding 12 months. Under no circumstances will we be liable for any indirect, incidental, consequential, or punitive damages.

6. Intellectual Property

6.1. You retain ownership of intellectual property rights in your listings.
6.2. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, and distribute your content in connection with providing the Service and promoting the Site.

7. Governing Law & Dispute Resolution

7.1. These Terms are governed by the laws of England and Wales.
7.2. You agree that any dispute arising from or relating to these Terms will be brought exclusively in the courts of England and Wales.

8. Modifications

8.1. We reserve the right to modify these Terms at any time.
8.2. Any changes will be posted on the Site and communicated by email at least 30 days before taking effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.

9. Assignment

Neither party may transfer or assign their rights or obligations under these Terms without the other's prior written consent, except that we may transfer these Terms in connection with a merger, acquisition, or sale of assets.

10. Severability

If any provision of these Terms is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions will remain in full force and effect.
